Terms and Conditions of the Loyalty Program

1. Purpose
The Minix France Loyalty Program (hereinafter referred to as the “Minix Loyalty Program”) is a program operated by One Up, a French simplified joint stock company (SAS) with a share capital of €302,000, registered with the Grenoble Trade and Companies Register under number 853 926 905, and whose registered office is located at 201 rue des Blaches, 38530 LA BUISSIÈRE, France. This program allows customers to earn points based on purchases made on the online store www.minixfigurines.fr, which can be redeemed for benefits.
2. Enrollment in the Minix Loyalty Program
To join the Loyalty Program, the participant must register as a member on the website by providing their email address and personal information. The following information is mandatory to enroll in the Program: last name, first name, postal address, and email. If this information is not provided, participation in the Program and receipt of offers or benefits will not be possible. The participant guarantees the accuracy of all information provided and shall be solely responsible for any incorrect, incomplete, or outdated information. Any incomplete enrollment request will not be processed. A confirmation email of the participant’s enrollment in the Loyalty Program will be sent to the email address provided at registration.
The Minix Loyalty Program is reserved for individuals residing in mainland France or Europe (excluding the United Kingdom) who have provided the personal data specified in Article “6. Personal Data” of these terms and conditions. The Minix Loyalty Program is reserved for individuals aged 16 or older.
One Up reserves the right to request, at any time, any document that may verify the identity of the person wishing to enroll or already enrolled in the Minix Loyalty Program, particularly in the case of individuals with the same name.
Within the framework of the Loyalty Program, the member account is created on a personal and unique basis, and benefits (points and rewards) may not be transferred, loaned, or sold, nor used for any purposes other than those defined by One Up in these terms and conditions.
Enrollment in the Program is free of charge.
Participants may withdraw from the Loyalty Program at any time by contacting One Up’s customer service department, whose contact details are provided in Article “9. Liability” of these terms and conditions.
3. Earning Points
Loyalty points are awarded when purchasing Minix products online at https://www.minixfigurines.fr/. Under the Minix Loyalty Program, each euro (€1) spent equals 1 loyalty point earned, as detailed in the table below:
Shipping costs are not included and do not grant loyalty points. Similarly, discount coupons or any other form of price reduction do not entitle the member to earn loyalty points on the discounted amount.
In case of order cancellation, refund request, or exercise of the right of withdrawal on the site https://www.minixfigurines.fr/, Minix reserves the right to deduct from the total number of accumulated points the points obtained from the purchase of the product(s) concerned.
Minix products purchased outside the Minix France website https://www.minixfigurines.fr/ are not eligible for the Loyalty Program.
4. Tracking of Points
Members can consult their point balance in their personal account on the website https://www.minixfigurines.fr/. Points are generated and visible after the order has been processed.
For any claim concerning the point balance related to online purchases made on https://www.minixfigurines.fr/, members may contact One Up’s customer service, whose contact details are indicated in Article 9 “Liability” of these terms.
Points accumulated in the account are valid for 24 months from their date of acquisition.
5. Benefits of the Minix Loyalty Program
Within the framework of the Minix Loyalty Program, each euro spent corresponds to the accumulation of 1 point. Once the member reaches 290 points, they are entitled to one free figure, to be chosen from the available 12 cm single figures, subject to stock availability.
Some products are not eligible as rewards under the loyalty program. These include 7 cm figures, 2-figure packs, 4-figure 7 cm packs, 5-figure 7 cm packs, and Blind Box figures (non-exhaustive list).
The loyalty program, which is based on a purchase obligation, allows the customer to obtain a free product once the required point threshold is reached. To claim this reward, the customer must apply the corresponding code during their next order, in accordance with the general conditions stated.
Once the order is confirmed and the points have been used, they are no longer available.
6. Personal Data
Personal information provided upon joining the Program (last name, first name, mailing address, email, phone number, etc.) is subject to the Privacy Policy available online: Online Privacy Policy. For more comprehensive information regarding the processing of their personal data, members are invited to consult the Minix Cookie Policy.
Members may, at any time, verify and/or modify the personal data entered in their account by accessing the “My Account” page on the site https://www.minixfigurines.fr/.
Members may exercise their right to object to the processing of their personal data for marketing and commercial profiling purposes or request the deletion or restriction of their data processing.
Information relating to members is retained by One Up for no longer than necessary for the purposes for which it was collected, i.e., for the duration of participation in the Minix Loyalty Program, extended by the applicable statutory limitation periods, in particular to retain proof of transactions and allow One Up to comply with its legal obligations.
7. Rights Reserved by One Up
One Up reserves the right to modify these terms and conditions and will inform members of any change by the means deemed most appropriate, such as by email or updating the website https://www.minixfigurines.fr/. The most recent version of the Loyalty Program terms and conditions is available on the website, and One Up encourages members to consult it regularly.
One Up also reserves the right to send personalized offers to specific Loyalty Program members, and to modify or suspend the Program. In the event of permanent discontinuation of the Minix Loyalty Program or a complete overhaul resulting in the loss of accumulated points, members will be notified by the means deemed most appropriate by One Up. Note that One Up cannot guarantee the reuse of unused points in case of a program change, and no modification, evolution, or deletion of the Program shall give rise to any compensation for the member.
One Up also reserves the right not to contact inactive members of the Minix Loyalty Program (those who have not made a purchase on the website https://www.minixfigurines.fr/ for more than 12 months) regarding any program updates.
If an order that generated loyalty points is refunded, the corresponding points will be deducted from the customer’s account. If a free product was obtained using accumulated points and the related order(s) are refunded, the free product must be returned to One Up. If the product is not returned, One Up reserves the right to deduct the value of the free product from the refund amount.
8. Suspension or Deactivation of Member Accounts
The Minix Loyalty Program requires members to comply with the terms and adopt fair behavior toward the brand. Consequently, One Up reserves the right to suspend or permanently deactivate a Loyalty Program account and cancel the associated benefits in the event of misuse of the program and/or towards One Up.
One Up will execute such suspension and/or deactivation after notifying the member by the means it deems most appropriate, without the member being entitled to any compensation, especially in the following cases:

Fraud, attempted fraud, or theft by the member on the website

Inappropriate use or misuse of the Minix Loyalty Program

Disruptive behavior affecting the website https://www.minixfigurines.fr/ or the Loyalty Program

Abnormally high number of transactions in a single day and/or across multiple days

Generally, non-compliance with the provisions set out in these terms and conditions

The member is informed that they may, in any event, resort to conventional mediation, via existing sectoral mediation bodies or any alternative dispute resolution method (e.g., conciliation), in case of dispute.

All disputes arising from the purchase and sale operations covered by these terms and not resolved amicably or through mediation shall be submitted to the competent courts in accordance with common law.
In case of dispute, French law shall apply by default, regardless of the customer’s country of residence, in accordance with applicable legal provisions.
